EU暢議的專利法庭對共同市場有利，但對申請人有利?

這篇文章的內容主要說明 DSS目前在歐洲的訴訟狀況，以及衍生的問題。

DSS是一家美國公司，發明了一種鈔票防偽的技術，並且獲得了EPO准予專利。它認為歐洲央行發行的歐元鈔票，侵犯了它的專利權，控告歐洲央行，要求侵權的賠償。

DSS一開始先向盧森堡來訴訟，但是盧森堡以他沒有管轄權駁回，於是DSS到每個歐盟國家進行訴訟。同時歐洲央行也在數個歐盟會員國的國家法院提起專利無效的訴訟。

目前已經有幾個國家有初步的訴訟結果，在英國最高法院暫時停止高等法院撤銷專利的決定，法國也有類似的決定。但是在荷蘭與德國則是專利有效，DSS準備進行侵權的賠償訴訟。

問題就來了，歐盟現在是一個共同市場，經濟事務應該有一體的標準，不同的國家司法系統對EPO所給予專利的看法不同，會導致整體市場的不一致性，對歐盟宣稱歐盟是單一市場的說法相當諷刺。所以歐盟應該會有進一步的作為。

但是對專利權人來說，歐洲專利法院會有幫助嗎？單一的歐洲專利法治制度下，申請人的專利是否有效是一翻兩瞪眼，全有或全無，如果申請人一個一個國家申請，英國不准專利，說不定德國還有機會。如果歐洲專利法院成立，申請人為了他的最大利益，說不定國家專利局的申請案將會激增喔。
